Basic concepts in Notary Services.

Notarization of documents. The notarization involves more than pressing a seal onto a notarial certificate. Basic Types: Oaths and Acknowledgements. Oath: It is a verbal statement swearing that a document is truthful. A person who takes an oath that is later found to be false may be charged with perjury. Acknowledgement:  It is a statement in which the signer declares to a Notary that they signed a document willingly for the purposes stated within it. If an oath is in the form of a written document, the person must sign the document in the Notary´s presence. The Notary must ask the signer the question (or similar one): "Do you swear under the penalties of perjury that the information expressed in this document (or statement) is truth, so help you God?" The signer must respond affirmatively with a statement like "Yes" or "I do". The Notary should request the signer to raise his/her right hand as the oath is administered. If the Notary is ever called into a court of law to testify about an oath, the judge will ask if the oath, affirmation, or acknowledgement was properly administered. An Affirmation: It is like an oath, is an act in which a person affirms the truthfulness of a statement or document under the penalty of perjury. The wording of an affirmation is similar to that of an oath like "Do you solemnly affirm, under the penalties of perjury, that the information in this document (or statement) is the truth? The signer must make an affirmative response or gesture to the Notary´s question.

Affidavit: It is a written statement made by  a signer, also known as Affiant, pledging that the statement is true. The Affiant must sign the affidavit in the presence of the Notary and make a verbal oath or affirmation under penalties of perjury.

Representative Capacity: An individual can only take an oath or affirmation, which means corporations, partnerships, or trusts cannot; however, a person can act in a representative capacity and sign on behalf of an organization. The person must swear or affirm to have both personal knowledge of the facts and the authority to sign on behalf of the corporation, partnership, or trust.

Jurat Certificates: The Notary must execute a formal notarial certificate called a Jurat for any document, requering an oath or affirmation. This is the Notary´s testimony that the statenent was properly sworn or affirmed out loud  and signed in the presence of the Notary. The certificate is generally found on the document brought to the Notary for execution. If a document doesn´t contain a Jurat, the Notary may complete the notarization by attaching a separate form, commonly known as a "losse certificate". It is important that the loose certificate is attached to the document and worded in a way that prevents it from being used fraudulently on a different document.

Dear client, the notary public is legally prohibited from assisting you in preparing, completing and understanding immigration documents; if you need legal advice, consult a licensed attorney.
